1. Acceptance of Terms

By accessing and using RateLimitShield's services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service. You must be at least 18 years old or have parental consent to use our service.

2. Service Description

RateLimitShield provides a Docker Hub proxy service that aims to eliminate rate limits and improve container image delivery performance. Our service includes:

  • Unlimited Docker image pulls without rate limiting (subject to fair use)
  • Global CDN caching for improved image delivery
  • Enterprise security with secure by design architecture
  • Real-time analytics and monitoring dashboards
  • Target 99.9% uptime with automatic failover
  • Priority support for paid plans

Third-Party Disclaimer: Our service relies on third-party providers including Docker Hub and CDN services. We are not responsible for the availability, performance, or policies of these third-party services.

3. User Accounts

Account Creation

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials.

Account Responsibility

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use our service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Distribute malware or malicious code
  • Attempt to gain unauthorized access to our systems
  • Interfere with the service's operation or other users
  • Use the service for cryptocurrency mining or similar resource-intensive activities

5. Subscription and Billing

Subscription Plans

We offer various subscription plans with different features and usage limits. All plans include unlimited Docker pulls and global CDN caching.

Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. Enterprise plans may include custom billing terms. Annual subscriptions receive a 20% discount.

Money-Back Guarantee

We offer a 30-day money-back guarantee for all paid plans, subject to our refund policy. Refunds are provided at our sole discretion and may be denied for violations of these terms, excessive usage, or abuse of our services. Administrative fees may apply.

Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. No cancellation fees apply.

6. Service Level Agreement (SLA)

Uptime Guarantee

We target 99.9% uptime for our service on a best-efforts basis. Service credits may be available for extended outages as outlined in our SLA document, subject to verification and our sole discretion. This guarantee excludes planned maintenance, third-party service failures, and circumstances beyond our reasonable control.

Planned Maintenance

We may perform planned maintenance with at least 48 hours advance notice. Emergency maintenance may be performed without notice when necessary for security.

Performance Standards

We strive to maintain optimal performance including global CDN response times and Docker image pull speeds. Performance may vary based on network conditions, geographic location, image size, and other factors beyond our control. We make no guarantees regarding specific performance metrics.

7. Data and Privacy

Your use of our service is subject to our Privacy Policy, which is incorporated into these terms by reference. We maintain enterprise-grade security practices:

  • We do not store, scan, or access your Docker images
  • All data is encrypted in transit and at rest
  • We follow secure by design principles
  • GDPR and CCPA compliant data handling
  • Regular security audits and penetration testing

8. Intellectual Property

RateLimitShield retains all rights to the RateLimitShield service, software, and documentation. You retain all rights to your data and Docker images.

9. Enterprise Support

Paid plan subscribers receive priority support with target response times on a best-efforts basis:

  • Free plan: Community support via email (target: 48 hours)
  • Pro plan: Priority email support (target: 24 hours)
  • Enterprise plan: 24/7 support (target: 2-hour response time)
  • Enterprise plan: Dedicated customer success manager
  • Enterprise plan: Phone and video call support available

Response times are targets only and may vary based on issue complexity, support volume, and business hours. We reserve the right to modify support terms with reasonable notice.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOU USE THE SERVICE AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RATELIMITSHIELD'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS LESS. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify, defend, and hold RateLimitShield and its officers, directors, employees, and agents harmless from any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the service, violation of these terms, violation of any rights of another party, or any content you submit or transmit through the service.

13. Termination

We may terminate or suspend your account and access to the service at any time, with or without cause, with or without notice, at our sole discretion. For material breaches, termination may be immediate. For non-material violations, we may provide 30 days notice when practical. Upon termination, you retain access to your data for 90 days to facilitate migration, after which data may be permanently deleted.

14. Changes to Terms

We may modify these terms at any time at our sole discretion. For material changes, we will provide at least 30 days notice by email or through our service. For minor changes, we may provide shorter notice or update immediately. Your continued use of the service after changes take effect constitutes acceptance of the new terms.

15. Governing Law

These terms are governed by and construed in accordance with the laws of Thailand, without regard to conflict of law principles. Any disputes arising from these terms or your use of the service shall be resolved exclusively through binding arbitration in Bangkok, Thailand, or through the courts of Bangkok, Thailand, at our sole discretion.

15. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, internet service provider failures, cyber attacks, or failures of third-party services upon which we rely.

16. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and RateLimitShield regarding the use of our services and supersede all prior agreements and understandings.
